Access to this file transfer system ("System") is for authorized users only, and is subject at all times to these terms and the following provisions of the Website Terms of Use for noblis.org which are hereby incorporated by reference: Section 6 (Website Services), Section 8 (Disclaimer of Warranties), Section 9 (Limitation of Liability), and Section 10 (Indemnification). The System is provided for clients of Noblis to transmit files to and from Noblis. Any actual or attempted unauthorized use of this System may violate state, federal, and international laws and result in civil and/or criminal penalties. By using this System, you accept and agree to these terms.

You are solely responsible for all transmissions (including any content of such transmissions) by you to and from the System (collectively, your "Content"). You represent and warrant that you own all right, title and interest (including all intellectual property rights) in, or have sufficient rights to use, your Content. You will not use the System to store, retrieve, transmit or view any material that contains or constitutes: (a) personally identifiable information, confidential information, classified information, unclassified but sensitive information, or "For Official Use Only" or similar information; (b) any material that is illegal, harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene, offensive, or otherwise unacceptable to Noblis (as determined in its sole discretion); (c) material that violates the intellectual property or other legal rights of others (including Noblis); (d) executable files; or (e) viruses, worms, "Trojan horses", corrupted files, or any other similar software or programs that may contaminate, damage or adversely affect the operation of another person's computer, any of Noblis' websites or systems, any software or hardware, or telecommunications equipment.

Although Noblis takes measures to secure and protect the System against unauthorized access, no data transfer system can be made entirely impenetrable. You acknowledge and agree that it may be possible for an unauthorized third party to intercept, access, modify, duplicate and/or distribute your Content. Noblis reserves the right to view, monitor, and record activity on the System without notice or further permission from you. You acknowledge and agree that Noblis may restrict, suspend, or terminate your access to all or any part of the System, and/or refuse, move, remove or refuse to transmit any content that is available on the System. You agree and acknowledge that Noblis undertakes no obligation or liability to you or any third party relating to (a) any of the foregoing actions; or (b) your use of the System, including any contents stored in or transmitted through the System (including without limitation, your Content). You should maintain independent copies of all of your Content.
